WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
I hereby declare my intent to play for the CAPITAL PIONEERS (Team), managed by the Salem Women's Football Assocation (SWFA), a member team of the Women’s Football Alliance (WFA), a women’s football league owned by Football Alliance, Inc. IN CONSIDERATION of being permitted to participate in any way in activities sponsored or run by the Team, SWFA, and/or the WFA, (hereinafter referred to, generically, as the "Activities"), including, but not limited to, full contact football drills, scrimmages and games. I, for myself, my personal representatives, assigns, heirs and next of kin:
1. ACKNOWLEDGE, agree and represent that (i) I understand the nature of full contact football and that I am in good health and in proper physical condition to participate in the Activities (ii) I do not suffer from any condition, illness or disability that would prevent or limit my participation in the Activities; and (iii) I have full coverage health and medical insurance that will cover me should I sustain any injuries while participating in any Activities.
2. FULLY UNDERSTAND that
(i) full contact football drills, scrimmages, and games involve risks and dangers of serious bodily injury, including permanent disability, paralysis and death (hereinafter referred to, collectively, as the "Risks"); (ii) that these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activities, the conditions in which the Activities take place, the negligence of the releasees named below; and (iii) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activities.
3. HEREBY RELEASE, DISCHARGE AND COVENANT NOT TO SUE the team, the SWFA, the WFA, their respective administrators, directors, agents, officers, members, volunteers and employees, and other participants, sponsors, advertisers, and if applicable, owners and lessors or premises on which the Activities take place (each considered one of the releasees herein) from all liability, claims, demands, losses or damages on my account caused or alleged to be caused in whole or in part by the negligence of the releasees or otherwise, including negligent rescue operations; and I further agree that if, despite this Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement, I, or anyone on my behalf, makes a claim against any of the releasees, I will indemnify, save, and hold harmless each of the releasees from any litigation expenses, attorney fees, loss, liability, damage or cost which may occur as the result of such claim.
I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this Agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
Photographs and Video Consent, Waiver, Indemnity, and Release
Photographs, Videos, and Voice Recordings
I, the undersigned, hereby grant permission to the Salem Women's Football Assocaiton (SWFA) and its representatives to take photographs, videos, or any voice recordings at any SWFA event or activity.
I further grant to the SWFA and their representatives the right to reproduce, use, display, and broadcast, distribute, and create derivative works of these images and recordings in any media now known or later developed. I acknowledge that the SWFA and/or The Capital Pioneers owns all rights to the images, videos, and voice recordings.
Waiver, Indemnity and Release
I hereby waive any right to inspect or approve the use of the images or recordings or any written copy. I further waive all moral rights. I also waive any rights to royalties or other compensation arising from or related to the use of the images, videos, or voice recording materials. I hereby release, defend, indemnity and hold harmless the SWFA from and against any claims, damages or liability arising from or related to the use of the images, recordings or materials, including but not limited to claims of defamation, invasion of privacy, or rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or use in composite form that may occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution.
I am 18 years of age or older and I am competent to contract in my own name. I have read this document before signing below, and I fully understand the contents, meaning and impact of this consent, waiver, indemnity and release. This consent, waiver, indemnity and release are binding on me, my heirs, executors, administrators and assigns.
